Terms and Conditions of Building Change Membership

1. Introduction

Welcome to Building Change, a digital membership service offered by In Sight Media International Ltd. (“In Sight Media”). Building Change aims to provide a safe and supportive environment for personal growth in areas such as emotional well-being, resilience and self-awareness. These terms govern all use of the Building Change membership platform. By joining, you agree to be bound by these terms.

2. Definitions

• “Platform”: The online coaching membership site located at change.insightpodcast.com.
• “Content”: Any material posted by In Sight Media or members, including but not limited to videos, worksheets, group calls, and recorded sessions.
• “Membership”: The contractual access granted to users in exchange for payment, subject to these terms.
• “User” or “Member”: Any paying individual using the platform.

3. Eligibility

Membership is available only to individuals who are 18 years of age or older. By joining, members confirm that they are responsible for their own emotional well-being and fully understand that Building Change is not intended to be a substitute for therapy, psychological treatment, or professional advice.

4. Membership Agreement

By subscribing, members agree to these terms, including any future updates. Members must ensure the confidentiality of their login details and agree not to share access with others.

5. Use of Recorded Content and Media Release

• Consent to Recording: Members participating in group calls consent to being recorded if they join with video enabled. Members may choose to disable their video (but not audio) to avoid appearing on recordings.
• Limited License: By participating, members grant In Sight Media a non-exclusive, revocable license to display their recorded audio and video content on the platform, accessible only by paying members.
• Revocation and Privacy: Members may request the removal of specific recordings for privacy reasons, subject to In Sight Media’s discretion.
• Disclaimer of Liability: Members are solely responsible for content shared in sessions. In Sight Media is not liable for any misuse or perceived misuse of member-provided content.

6. Nature of Services and Disclaimers

• Not Therapy: Building Change, operated by In Sight Media, is a coaching and educational service only. It does not replace therapy, psychological treatment, or medical advice.
• No Guarantee of Results: In Sight Media does not guarantee specific results or outcomes from membership participation.
• Self-Responsibility: Members are responsible for their own commitment and engagement with the program. Any decisions made based on content or advice provided are at the members’ own risk.

7. Membership Fees and Payment Terms

• Payment and Renewal: Membership fees are billed monthly. Pricing tiers are as follows:
  • Level 1: £85 per month, includes a minimum of three weekly videos.
  • Level 2: £97 per month, includes everything in Level 1 plus a weekly group call, a relevant worksheet, and access to a private online community.
  • Level 3: £120 per month, includes everything in Level 2 plus an additional monthly group call.
• Member-Initiated Cancellation: Members may cancel their membership at any time via the payment platform. No refunds are available, and access will end at the conclusion of the current billing period.
• Platform-Initiated Termination: In Sight Media reserves the right to terminate any member’s account if they breach these terms. Such termination may occur without prior notice and without a refund for the remainder of the billing period.

8. Prohibited Conduct

Members agree to maintain a respectful and supportive environment on the platform. Any form of abuse, including but not limited to harassment, hate speech, discrimination, or intimidation of other users, is strictly prohibited. In Sight Media reserves the right to investigate and take appropriate action, including termination, for any violations of this conduct policy.

9. Limitation of Liability

• No Liability for Emotional Outcomes: In Sight Media, its operators, and affiliates are not liable for any emotional distress or negative experiences members may encounter.
• Financial Liability: In Sight Media’s financial liability is limited to the amount the member has paid for their subscription in the 12 months preceding a claim.
• Indemnification: Members agree to indemnify In Sight Media from any claims, damages, or expenses arising from their use of the platform, breach of terms, or participation in recorded sessions.

10. Intellectual Property

All content on the platform, excluding member-generated content, is the intellectual property of In Sight Media. It may not be reproduced or shared outside the platform without explicit permission.

11. Privacy and Data Protection

In Sight Media is committed to protecting member privacy in compliance with the Data Protection Act 2018 and UK GDPR. For more details on data handling, please review our Privacy Policy.

12. Governing Law and Jurisdiction

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of English and Welsh courts.

13. Amendments

In Sight Media reserves the right to update or modify these terms. Notice will be provided to members via email or platform notification.

14. Acceptance of Terms

By subscribing, members acknowledge they have read, understood, and agree to these terms.

However, for the purposes of recording the episode, your video image will be shared with Helen and Katie and edited out on request. We are unable to disguise voices, and your voice will be used.

   Please note that once you have featured on the podcast, the episode will be publicly shared and disseminated through various channels, including but not limited to podcast platforms, social media, and our website. The purpose of sharing your story is to engage with our audience and foster meaningful discussions. The podcast is freely available and In Sight can offer no guarantees that it will not be heard by those known to you.
4. Editing and Adaptation:
   We may request that you edit, modify, or adapt your story for clarity, length, or content during the recording process.
5. Intellectual Property:
   By submitting your story, you confirm that you are the rightful owner of the content or have obtained all necessary permissions and rights for its use. You agree that any intellectual property rights associated with your story will be assigned to us, and you waive any claims of ownership or royalties.
6. Discretionary Use:
   Submission of your story does not guarantee its inclusion in our podcast. Our team will review all submissions and select content based on relevance, quality, and suitability for our audience and this will be confirmed by email. We may also choose not to use your story without providing explicit reasons or feedback.
7. Indemnification:
   You agree to indemnify and hold harmless our podcast, its hosts, affiliates, and employees from any claims, damages, or liabilities arising out of the use of your story, including but not limited to defamation, infringement of intellectual property rights, or violation of privacy laws.
8. Cancellation and retraction:
   You may retract your story and cancel any scheduled recording sessions up until the recording is complete by emailing [email protected] or responding to your recording invitation email. Unfortunately after the recording is complete it is not possible to retract or cancel your involvement,
